Q1: Who is eligible to receive a Partial Premium Payment?
A1: Timely Class 5 and 6 Claimants who were approved for and accepted a Rupture or a Disease Base payment may be eligible to receive a Partial Premium Payment.
Q2: How much will my check be?
A2: The District Court approved payment of fifty percent (50%) of the Premium Payment amounts listed in Annex B to the Settlement Facility and Fund Distribution Agreement. So, a class 5 Claimant who received a Rupture Base payment is eligible to receive a $2,500 Rupture Partial Premium Payment at this time.
Q3: When will I receive my check?
A3: Partial Premium Payments will be processed based on the date the Base payment was issued. Base payments made first will receive their Partial Premium Payment first. If you are represented, your Partial Premium Payment check will be sent to your attorney.
Q4: Are Conditional (NOI) Claimants eligible for Partial Premium Payments?
A4: Conditional (NOI) Claimants may be eligible to receive a Partial Premium Payment for their approved and accepted Disease Claim. However, pursuant to Section II, #10 (c) of the September 7, 2007 NOI Consent Order, “Partial Premium Payments shall be paid only if and to the extent that Settling Personal Injury Claimants (as defined in the Plan) who are not NOI Claimants receive Partial Premium Payments for Rupture claims”. At this time Rupture Partial Premium Payments will not be made to Conditional Claimants.
Q5: Are Participating Late Claimants eligible to receive Partial Premium Payments?
A5: Pursuant to Section A, 3 of the December 12, 2007 Participating Late Claimant Order, “DCC Eligible Late Claimants shall not be eligible for Partial Premium Payments”. Q6: How can I expedite my partial Premium Payment check? A6: Your partial Premium Payment check will be processed in the order in which your Base payment was issued. The SF-DCT is not able to consider requests to process your partial Premium Payment early. However, you can prevent your payment from being held if you:
- Keep your address current with the SF-DCT and
- Respond quickly to any requests for documents from the SF-DCT
